As part of our General Law Practice, we register marriages and provide pre- and post-marriage counseling, including preparing and filing the application and notifying you of any objections from the authorities.

In India, a marriage can be registered under either the Hindu Marriage Act 1955 or the Special Marriage Act 1954. The Hindu Marriage Act applies only to Hindus, while the Special Marriage Act applies to all Indian citizens.

Requirements

  • Minimum age: 21 for males, 18 for females
  • Parties to a Hindu marriage must be unmarried or divorced, or if previously married, the prior spouse must not be living
  • Both parties must be physically and mentally healthy
  • Parties must not be related in a way prohibited by law
  • Affidavits from both prospective spouses (we'll draft these)

Under the Hindu Marriage Act

  • Name, father's name, address, and place where the marriage was solemnized
  • Duration of residence at the given addresses
  • Proof of marriage under the Hindu Marriage Act
  • Signed Vakalatnama

Both parties must appear before the Registrar with at least two witnesses; one witness must be a gazetted officer with their official seal. The marriage must be registered within one month of the wedding date, though authorities can condone delays depending on the circumstances.

Under the Special Marriage Act

  • Name, father's name, address, and place where the marriage was solemnized
  • Duration of residence at the given addresses
  • Proof of marriage, if already celebrated
  • Affidavits from both prospective spouses (we'll draft these)

Both parties must appear before the Registrar with two witnesses, each at least 18 years old.

Pre-Marriage Counseling

Most clients for this service are young couples, and in many cases their parents or guardians haven't been informed. If both prospective spouses are within the legal age and there's no indication of foul play — kidnapping, coercion, or similar — we don't notify their parents.

We counsel both parties on the legal, personal, and social aspects of marriage, and the changes that follow. The counseling happens across four stages in a single sitting; because the process itself matters to its effectiveness, we don't publish the full structure here. Our aim is to confirm the couple's honesty and gauge their commitment to each other. A session usually takes about an hour.

Post-Marriage Counseling

Most marriages have their ups and downs, and it's natural to want to step back and work through difficult periods. We help couples work through questions and problems to sustain the marriage — common issues for newly married couples include communication gaps, over-communication, ego conflicts, occasional minor conflict, and outside pressure from peers or family.

Non-Traditional Marriage

There's a lot of confusing information out there about legal marriage options in India, especially around non-traditional or "court" marriages. If both prospective spouses are qualified and eligible to marry, they have two options:

  • Marry according to religious rites, then register the marriage afterward
  • Marry directly under the Special Marriage Act

Things to Remember

  • There's no such thing as a "Marriage Deed"
  • A so-called "notarized marriage" isn't legally valid
  • Once married, the marriage can't be undone without a proper divorce order
  • If the marriage doesn't have the consent of the prospective wife's parents, it's advisable to involve an advocate to avoid complications — we're legally authorized to represent, advise, and counsel you

Refund Policy

Cancel within 2 days of ordering and we deduct 25% as a cancellation fee, refunding the balance with no questions asked; after that period, the service fee isn't refundable.
