Hire us: as part of our NGO Support Services, we register Charitable Trusts under the Indian Registration Act.
Like other forms of NGO, a Charitable Trust is an independent legal entity. Trustees and settlors generally aren't personally liable for the trust's acts, though they're liable in their official capacity. A Charitable Trust is essentially a transfer of property deed for charitable purposes, in favor of named beneficiaries — the Press Trust of India (PTI) is one well-known example.
Requirements
- At least one settlor (the person forming the trust)
- At least one trustee (the settlor and trustee may be the same person)
- At least one witness
- Some property to form the trust (generally Rs. 1,000)
Documents We Need
- ID proof of the settlor, trustee, and witness
- Water bill or house tax receipt as address proof of the registered office
- Charitable Trust Deed on stamp paper (we'll draft this)
- Signed Authority Letter (download here)
A public charitable trust is usually recommended when property is involved, especially land or buildings. We provide a free basic profile with every registration.
The Trust Deed
This is the main instrument of any public charitable trust, setting out its aims, objects, and mode of management. Every deed must specify the minimum and maximum number of trustees, the trust's aims and objects, how it's managed, and how trustees may be appointed or removed. It must be signed by the settlor(s) and trustee(s) in front of two witnesses.
Registration
The deed is executed on non-judicial stamp paper, valued according to the trust property. The registration application goes to the official with jurisdiction over the region where the trust is being registered. For registration, the settlor, trustee, and at least one witness must be physically present at the Registrar's Office.
