Procedure

  1. Trademark Search — we search all relevant classes before filing, to confirm there's no identical or similar mark already registered or under application.
  2. Filing the Application — the application is filed with the Registrar of Trademarks.
  3. Publication in the Trademark Gazette — if the mark is found distinctive on preliminary examination, the Registrar orders its publication. If no opposition is filed within 90 days of publication (or 120 days if an extension is granted), the mark proceeds to registration.
  4. Trademark Registration — the mark is registered and a certificate is issued by the Registrar of Trademarks.

What Is a Trademark?

A trademark is a word, phrase, symbol, or design (or combination) used in trade to identify and distinguish the source of one enterprise's goods or services from another's. A service mark works the same way but identifies a service rather than a product — a goods mark typically appears on the product or packaging, while a service mark appears in advertising.

A trademark differs from a copyright (which protects original artistic or literary work), a patent (which protects an invention), and a geographical indication (which identifies goods with characteristics tied to a specific territory).

Classification of Goods & Services

Most jurisdictions, including India, group goods and services into classes for registration purposes, generally following the International Classification of Goods and Services — 34 classes of goods and 8 classes of services (WIPO has since added three further service classes under the Nice Classification, not yet implemented in India). Printed matter, newspapers, and periodicals fall under Class 16, for example, while publication services fall under Class 41.

Rights Conferred by Registration

Registration grants the proprietor the exclusive right to use the trademark for the goods or services it covers. Registration isn't compulsory, but it offers significantly stronger legal protection in an infringement action.

Who Can Apply

Anyone can apply for trademark registration at the Trademark Registry covering the jurisdiction of their principal place of business in India. For a company not yet formed, an individual may apply in their own name for later assignment of the registration to the company.

Refund Policy
