There are two types of affidavits: Judicial and Non-Judicial.
Judicial affidavits are drafted on judicial paper along with proper court fee stamps affixed. These affidavits are required for various purposes, including but not limited to, serving as evidence or supporting an application. To be valid, a judicial affidavit must be attested by an Oath Commissioner.
Non-judicial affidavits are drafted on non-judicial stamp paper. The value of the stamp paper varies from state to state, but it is generally not less than Rs. 10/-. Non-judicial affidavits are primarily used for administrative or commercial purposes. To be valid, the affidavit must be attested by a Notary Public with a current valid license.
Affidavits are required for different purposes including but not limited to change of name, getting a new passport or driving license, renewal of passport, as no objection certificate (NOC) or for filing a case in a court. The estimated time for completion depends on the location of Deponent. In major cities like Delhi, Mumbai, Bangalore, and Chennai, obtaining the Affidavits typically takes 5-6 business days. Smaller cities may require additional time, while remote areas may experience even longer processing times.
